These Terms of Service ("Terms") govern your access to and use of the RNDV mobile application, the website at clubrndv.com, and related services (together, the "Service"), operated by Delage Media Group, Inc. ("RNDV," "we," "us," or "our"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who can use RNDV

You must be at least 18 years old to create an account or use the Service. By using RNDV you represent that you are 18 or older and that the information you provide is accurate. We collect your date of birth at sign-up to confirm eligibility; accounts found to belong to anyone under 18 are removed.

You must also be legally able to enter into a binding contract with us and not barred from using the Service under the laws of your jurisdiction.

2. Your account

• You are responsible for your account, including keeping your login credentials secure and for everything that happens under your account.
• You agree to provide accurate information and to keep it current. Impersonating another person or misrepresenting your identity is prohibited.
• You may not share, sell, or transfer your account.
• Notify us at Hello@clubrndv.com immediately if you suspect unauthorized use of your account.

3. How RNDV works

RNDV lets members signal that they are at a real-world venue and open to meeting up ("going on the air"), see other members' activity on a map, coordinate plans, message one another, and share content. Features and availability may change over time, and we may add, modify, or remove features at our discretion.

4. Membership and billing

RNDV offers a free tier and a paid membership ("Club RNDV"). When paid membership is available:

• Subscriptions are billed through your Apple App Store account in accordance with Apple's terms.
• Subscriptions auto-renew at the end of each billing period (monthly or annual) unless you cancel at least 24 hours before the period ends.
• You can manage and cancel your subscription in your iOS Settings → Apple Account → Subscriptions.
• Prices are shown in the app before you purchase. Pricing may change; we will give notice as required by law.
• Except where required by law or by Apple's policies, payments are non-refundable. Refund requests for App Store purchases are handled by Apple.

5. Community standards — acceptable use

RNDV is a members club built on mutual respect. You agree not to use the Service to:

• Harass, bully, threaten, stalk, or intimidate anyone;
• Post or share content that is hateful, discriminatory, sexually explicit, violent, or otherwise objectionable;
• Engage in predatory behavior, solicit minors, or facilitate any illegal activity;
• Impersonate any person or entity, or misrepresent your affiliation;
• Spam, solicit, advertise, or send unsolicited commercial messages;
• Collect or harvest other members' data, or use the Service to build a competing product;
• Circumvent, disable, or interfere with the Service's security or moderation features;
• Use the Service in a way that violates any applicable law.

We screen public content for clearly objectionable material before it is posted, provide tools to report and block other members, and may remove content or suspend or terminate accounts that violate these standards. See Section 8.

6. Your content

You retain ownership of the content you create on RNDV — your profile, photos, messages, and other submissions ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content solely to operate and provide the Service (for example, showing your airing to the audience you choose, or displaying your story photo to members at a venue). This license ends when you delete the content or your account, except for copies retained in backups for a limited period or as required by law.

You are responsible for your User Content and represent that you have the rights to post it and that it does not violate these Terms or any law or third-party right.

7. Safety and assumption of risk

You meet other members at your own risk. You are solely responsible for your interactions with other members. Take the precautions any sensible adult would take when meeting someone new:

• Meet in public places, at least at first.
• Tell a friend where you're going and who you're meeting.
• Don't share sensitive personal or financial information with members you don't know well.
• Trust your instincts; leave any situation that feels unsafe.
• Report concerning behavior in-app, and contact local authorities in an emergency.

To the fullest extent permitted by law, you assume all risk associated with using the Service to meet other members in person, and you release RNDV from claims arising out of such meetings.

8. Moderation and enforcement

We may, but are not obligated to, monitor the Service. We may remove content, restrict features, or suspend or terminate accounts — with or without notice — for any conduct we determine, in our reasonable judgment, violates these Terms or harms other members, the Service, or third parties. Reports submitted in-app are reviewed by our team, typically within 24 hours.

9. Intellectual property

The Service, including its design, software, branding, and the RNDV name and marks, is owned by Delage Media Group, Inc. and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, reverse-engineer, or create derivative works of the Service except as permitted by law.

10. Third-party services

The Service relies on and links to third-party services (including Apple, Supabase, MapTiler, and others described in our Privacy Policy). Your use of those services may be governed by their own terms. We are not responsible for third-party services.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, Delage Media Group, Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service, or your interactions with other members, whether based on warranty, contract, tort, or any other legal theory. Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) one hundred U.S. dollars (USD $100).

13. Indemnification

You agree to indemnify and hold harmless Delage Media Group, Inc. from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, your interactions with other members, or your violation of these Terms or any law or third-party right.

14. Termination

You may stop using the Service and delete your account at any time (Profile → Delete Account). We may suspend or terminate your access at any time for the reasons described in these Terms. Sections that by their nature should survive termination — including content license terms already exercised, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

15. Governing law and disputes

These Terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Minnesota, and you consent to their jurisdiction — except where applicable law gives you the right to bring a claim in your local jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will revise the "Last updated" date above and, where appropriate, notify you in the app or by email before the changes take effect. Your continued use of the Service after the changes become effective constitutes acceptance of the revised Terms.
